Request to replace the sentence

A request to replace the custodial sentence with one of the alternative measures stipulated by law shall be submitted by the convicted party or their lawyer via an official power of attorney. This request can take place in all cases where final judgments have been issued and where the penalty period does not exceed the legally prescribed year. After hearing the statements of the Public Prosecution and upon receipt of a statement from the Public Prosecution, the request is presented to the Execution Judges to study the request and issue a decision of approval or rejection. If approved, a copy of the approval is sent to the Public Prosecution to take the necessary action according to the procedures followed in this regard.
