Request for the issuance of a Religious Ordinance Document

The service of issuing a religious obligation document, which is a document that lists the heirs of the deceased and determines the share of each individual according to Islamic Sharia Law.

Service Conditions

  • Certification of documents that have been issued outside Bahrain at the Ministry of Foreign Affairs and the country’s embassy
  • Translating documents that have been issued in a language other than Arabic in an accredited translation office
  • The applicant must be an heir or an official agent

Required Attachments

  • Copy of the official power of attorney for any individual who delegates their representative to submit the application
  • Completed form requesting a Religious Ordinance Document
  • Death certificate issued by the Information and eGovernment Authority
  • Copies of the Identity Card or passport of the deceased, heirs and witnesses
  • Copy of the official legal will of the deceased (if any)
  • The deceased who does not hold Bahraini citizenship must bring an official letter from the embassy of his country, stating: the names, number of heirs, and their degree of relationship to the inheritor.

Note

  • The deceased who does not hold Bahraini citizenship must bring a list of legal heirs certified by the government of their country or an official letter from their country’s embassy displaying the names and number of the heirs and the degree of their kinship with the bequeather

  • Ministerial Resolution No. (3) of 2017 regarding the procedures for issuing documents for which the Sharia Procedures Judge is competent

Service Processes

  • Access the Ministry of Justice, Islamic Affairs and Waqf website at https://www.moj.gov.bh. Navigate to the Forms menu and select the form designated for the application.
  • Print the form, fill it out by hand, and attach the required documents
  • Send the form and documents to the email of the Department of Sharia Research (Obligations): shareya.research@moj.gov.bh
  • Within 5 working days, the applicant will be contacted by phone to schedule a court appearance
  • On the appointed date, one of the heirs or his official representative, along with two witnesses who know the deceased and the heirs, shall visit the relevant court with the original documents submitted
  • Attachments and forms are sent in one file via email to sr@moj.gov.bh
