Request for issuance of a waiver in a Religious Ordinance document

The service of issuing a waiver document in a legal obligation, which is a document according to which the heir’s donation of his legal share devolved to him through the legal obligation of some or all of the heirs is proven.

Service Conditions

  • Legalization of documents issued approved via the Ministry of Foreign Affairs and Bahrain embassies
  • Translation of documents in foreign language in an approved translation office
  • The applicant must be a principal or an official agent

Required Attachments

  • If the property is mortgaged, a letter of approval for the gift must be obtained from the mortgagor
  • If the property can only be acted on following an approval an approval by a government or private entity, an approval must be obtained from this same entity
  • Identity card of the disposer and beneficiary (assignor, assignee)
  • Ownership document for the relinquished property (real estate document, commercial register, etc.)
  • An official power of attorney that stipulates the right to assign it to anyone who wants to appoint an agent to sign on his behalf.

Service Processes

  • Go to the website of the Ministry of Justice, Islamic Affairs and Waqf https://www.moj.gov.bh and access the service entitled “forms”. Choose the relevant application form
  • Print the form, fill it out by hand, and attach the required documents
  • Send the form and documents to the email of the Department of Sharia Research (Obligations): shareya.research@moj.gov.bh
  • Within 5 working days, the applicant will be contacted by phone to schedule a court appearance. On the scheduled date, the original submitted documents must be presented, along with the attendance of: In the Sunni court chamber: only the disposer (the assignor). In the Jaafari court chamber: both the disposer and the beneficiary (the assignor and the assignee).
