Issuance of a conditional gift (umra shariyah) document
Issuance of a conditional gift (umra shariyah) document service, according to which the owner’s gift of his property to someone to use it for the purpose of housing for a specific period. This period takes place from the date of concluding the conditional gift (umra) contract until the death of the beneficiary, after which, the property returns to the administrator if they are alive or their heirs if they are deceased. If there is a kinship between the beneficiary or administrator, the relationship must be proved.
Service Conditions
- The applicant must be a principal or an official agent.
Required Attachments
- Completed application form for a legal document
- Copies of the Identity Card or passport of the administrator and the beneficiary (mu’emer and mu’emar alaih)
- All pages of the real estate document
- Evidence of the kinship between the administrator and the beneficiary: For couples: a marriage contract is required, For a mother and her children: the children’s birth certificate is required, For a cousin (descendant/child of a maternal uncle): the birth certificate of the administrator is required, For a cousin (descendant/child of a maternal aunt): birth certificate of the administrator and the beneficiary, For the kinship relationship between the father and his children, brothers, paternal cousins, and so on, the name recorded in the Identity Card or passport is sufficient
- A copy of the official power of attorney stipulating Al-Omari’s right for anyone who wants to delegate his agent to sign on his behalf
- If the property is mortgaged, a letter of approval for the conditional gift must be obtained from the mortgagor

Service Processes
- Go to the website of the Ministry of Justice, Islamic Affairs and Waqf https://www.moj.gov.bh and access the service entitled “forms”. Choose the relevant application form
- Print the form, fill it out by hand, and attach the required documents Send the form and attachments in one PDF file to the email: sr@moj.gov.bh
- Send the form and documents to the email of the Department of Sharia Research (Obligations): shareya.research@moj.gov.bh
- Within 2 - 5 working days, the applicant will be contacted by phone to schedule a court appearance on a specified date, bringing with them the original documents to be submitted. If the applicant is attending their appointment at the Sunni unit, only the administrator must attend, If the applicant is attending their appointment at the Jaffari unit, both the administrator and the beneficiary must attend.
- On the specified date: The Sunni Department requires the presence of only the person disposing of it (the custodian), and in the Ja`fari Department: the attendance of both parties is the person disposing of it and the beneficiary (the custodian).
- For the Jaafari court chamber: both the administrator and the beneficiary (the elderly person and the person being cared for) must attend.
