Submitting a request for arbitration (according to the Chamber’s jurisdiction by parties agreement)

Arbitration at the Bahrain Chamber for Dispute Resolution (the Chamber) is an alternative means of settling a dispute, in which the parties give jurisdiction to the Chamber by signing a binding agreement that enables the Chamber, in accordance with its rules, to appoint a neutral arbitrator or an arbitral tribunal to decide the dispute. This Tribunal issues a binding and enforceable Award.

Service Conditions

  • Submit a request for arbitration in accordance with the requirements of the Rules of Arbitration of the Bahrain Chamber for Dispute Resolution
  • Pay the Arbitration filing fees

Required Attachments

  • Fill out the arbitration request form
  • Copy of the arbitration agreement
  • A copy of any contract out of or in relation to which the dispute has arisen.
  • A statement summarizing the nature and circumstances of the dispute.
  • A statement summarizing the claims and the estimated value of any monetary claims.
  • A statement relating to any proposal, or agreement between the parties regarding the constitution of the arbitration tribunal, the seat of the arbitration, the law applicable to the substance of the dispute, and the language(s) of the arbitration. remedies, and accompanied by all documents essential to the claim.
  • In the event that the dispute falls under the expedited procedures (the claim amount does not exceed 1 million USD) the Claimant shall submit a Request conforming to the provisions above, save that, in place of the statements prescribed by the points 4 and 5, the Request shall include the Claimant’s Statement of Claim, setting out in detail the remedies sought and the amount of any monetary claim, together with the factual and legal basis for its entitlement to such

Legal Regulations

  • The Rules of Arbitration of the Bahrain Chamber for Dispute Resolution issued by the Chamber’s Board of Trustees pursuant to Article (27) of the Legislative Decree- No. 30 of the year 2009 with respect to the Bahrain Chamber for Economic, Financial, and Investment Disputes Resolution and its amendments.

Fees

The Chamber administration fees include the following:

  • A non-refundable arbitration filing fee of US$3,000 (equivalent to BD1,131/-).
  • A Case Management fee, based on the value of claims and counterclaims as set out in the Case Management Fee Schedule.

Service Processes

  • The claimant shall submit to the Chamber and all the parties a written request for arbitration that meets the requirements of Article (2-2) of The Rules of Arbitration of the Bahrain Chamber for Dispute Resolution.
  • The claimant shall provide documentary proof that the copies of the Request have been sent to all the other parties either with the Request or after.
  • The claimant shall pay the Arbitration filing fees in cash, or by cheque made payable to the Chamber, or via bank transfer to the Chamber’s account or by credit card.
  • After verifying that the requirements for filing the arbitration request have been met, the Chamber communicates with the parties to inform them of the commencement of the arbitration procedures.
