Religious Ordinance Document Issuance Request

This service is provided by the Ministry of Justice, Islamic Affairs and Awqaf to Individuals requesting to obtain a religious ordinance document, such document enables its possessor to identify the heritage and to select the rightful heirs and to avoid excluding or including persons whom are not entitled of the inheritance.

   Required Documents

  1. Obligatory legitimacy application form
  2. Copy of the death certificate
  3. Copy of the Identity Card and passport of the deceased with the assurance of the conformity of the name in therefore, if the legacy (inheritance) includes the property
  4. Copies of Identity Cards or passports for the heirs with assurance of the conformity of the names in therefore, if the legacy (inheritance) includes the property
  5. The official power of attorney (if applicable)
  6. Copy of the property’s document
  7. Copies of the previous religious ordinance, if the application is to perform Shari’a conformity of copies
  8. Copy of the will, where the will should be official and ratified by the court before the decease
  9. Present two witnesses who know the dead person and the heirs, on the date specified by the computer system

   Important notes

  • Others:
  1. If the deceased person divorced his wife a reactionary divorce (first or second rounds) and passed away prior the end of the mourning period, she is still considered as his wife, and her name should be included within the heirs.
  2. If the heir(s) passed away without knowing who died first, the applicant should visit the Ministry to clarify.
  3. The heirs are: the father, mother, the husband, the wives and sons (including boys and girls and stabilized pregnancy). In case of the non-existence of an heir within those previously mentioned groups, the legacy will be disinherited from the rest of the relatives, as per the followed sect (Sunni or Jaffari).
  4. Other relatives that can be included in the legacy (Heritage) are: Grandsons, grandfathers, brothers, uncles, and maternal uncles), as per the degree of the kinship.
