Donation (Hibba) Certificate Issuance Request

This service is provided by theMinistry of Justice, Islamic Affairs and Awqaf to Individuals requesting to obtain a donation (Hibba) certificate which is an agreement that enables the individual to grant money to another person without any compensation.

   Required Documents

  1. The original of the property’s document, or the official deed for the subject of the donation
  2. Copy of the property’s document, showing the number of the document and the last number of the property’s deed
  3. Copies of the Identity Card or passport of the donation grantor, with the assurance of the conformity of the names between the Identity Card and passport
  4. Copies of the Identity Card or passport of the donation receiver, with the assurance of the conformity of the names between the Identity Card and passport
  5. Copy of the Shari’a deed, in case of donation, or surrender shares from the deed (if applicable)
  6. Copy of no objection certificate from the mortgager, in case of the mortgage of the property decided to be granted
  7. Letter of no objection from of disposition of the property from Ministry of Housing if the property to be dowed is a housing unit
  8. Fill donation (Hibba) application form
  9. Approval letter if the property is mortgaged
  10. Copy of the power of attorney if the applicant is willing to authorize another person to sign in the court

   Important notes

  • Others:
  1. It is not allowed to specify the donation to one of the sons, without the approval of the other sons.
  2. In case of the approval of the sons to the donation of their father to their sibling, they must all attend, or attest their acknowledgement by an official letter, with the attendance of one of them before the court.
  3. Only the donation grantors should attend at the time specified by the computer system.
  4. The donation contract attested by the Sharia Courts, and which validity date shall continue for one year from the date of its attestation, unless it has been renewed once again and registered at Survey and Land Registration Bureau.
  5. The donation grantor may have the right to retreat from his donation, unless it is has been attested at Survey and Land Registration Bureau and the retreatment is in conformity with the conditions of donation’s retreatment.
